My car was rearended; the person who bumped into me got a ticket and their insurance company are going to pay for the damage to my car. At first I thought I was OK, and the insurers said they would give me a cheque for $100 just because I was in a crash, and was not claiming medical expenses. But after five days, my neck began to hurt...and hurt...so much that I could hardly turn it. Over thanksgiving it was really painful. I haven't been to the doctors yet, as it was thanksgiving. It feels like muscular pain, and I think if I do go to a doctor it should be either an orthopaedic doctor or a chiropractor. Yet now, after a week of hurting an awful lot, my neck is feeling a lot better.
What should I do about the insurance? Do I ask for a payment (a bit more than $100 seems justified after all this), or do I wait and see a doctor? Or go to an attorney? If my neck now gets completely better, what is the best way to deal with the insurance? I can't tell now whether or not it will.

I am hoping at this point that you did not sign anything to do with the insurance company and the 100 dollars---if you have--this may be a VERY difficult road for you indeed----Because, usually it is the practice of insurance companies (knowing that injuries like this usually take several days to surface) to come at you really rapid (under the guise of being really really interested in getting you "taken care of") and make these really super fast offers to people ----and of course they want you to sign a release in order to keep them from having to deal with any other claims against them !!! And they make out like bandits in the process !!
If you in fact have not taken the money--and have not signed any releases---you first get your injury looked into and get a verification from a medical professional that you in fact DO have an injury that is crash related---as soon as you get THAT verification---you get to an injury attorney IMMEDIATELY to talk over the particulars of this event with them----they will take all of the information about who--where--when--how etc etc ---and if the attorney is worth their own salt---they will take it all up from there !!!
But--if you have already signed a release with these people and taken the 100 dollars---you could be immensely screwed !!!

You don't have to settle now. You can see how you feel. But the longer you go without treatment, the less likely you'll be to get anything. If you're hurt that badly the argument will be why no treatment?
You don't need an attorney. There are people out there who will say if you get a hangnail to get one, but you don't have to have one. That's up to you, no one can say yes or no, don't get one.
The $100 was offered to you sight unseen with no treatment, and I'm sure that offer still stands. If you intend to wait it out, which is not a bad choice as these kinds of injuries go away in a few weeks, then really should you be entitled to more? But you should know that the longer you go without having treatment the less likely you'll be to get something. I think I already pointed that out. So do something soon. Either see your doctor to make sure you're ok, or ask for another $100 to be done with this.

Get a good attorney. Go to see a good doctor who should take x rays and an MRI test to see if any tissue or bone damage was done, internally, during the accident. Bones of the upper neck are easily dislocated. Only the tests will show the facts. Do not rely on feeling alone. The attorney will handle the insurance company. Stop worrying and see a doctor ASAP.

First you need to see a doctor to get it documented that you have an injury do to the accident. It may be whiplash or a strained muscle, either way get it checked out ASAP and then see about a lawyer if necessary. Make sure you don't sign anything until you see a doctor to see if its a major or minor injury. I would prefer a chiropractor my self. good luck

Have you tried going to your nearest emergency room? Why would you accept $500 for a injury like that involving a car accident? That isn't merely enough to even get you a shot. Explain your situation to the attending physician and he/she will probably get you started on physical therapy if needed, or something of the sort.

the reason ur neck started to hurt 5 days later is because when ur in a car accident ur body is an shock then once u come down ur body starts too feel the real pain from the accident well good luck!!!!!!!!!!

CALL THAT INSURANCE COMPANY AND LET THEM KNOW YOU ARE GOING TO THE EMERGENCY ROOM.
AND GO.. NO MATTER WHAT THEY SAY...
ALSO AFTER GOING YOU WILL KNOW IF YOU NEED ATTORNEY OR NOT.
