we are marrying in march because he will be here on a tourists visa then. can we marry first then see a lawyer?

I would strongly recommend seeking the advice of a lawyer now, to get all the correct information you can. You do not want to lessen the chances of your fiance to come back to or stay in your country. If you are in the U.S., you can apply for a fiance visa, but if you get married first while he is here on a tourist visa, he may very well have to go back to his country first and wait for the visa to be approved, depending on how long the tourist visa is for.

It really is best to get all of your facts straight before proceeding. Consult a lawyer this coming week, and/or go read through all of the immigration information on your country's immigration website. Best to be informed and ready to deal with whatever you have to deal with.

Stop! You need to do it the right way. First you need for him to get a K-1 visa (fiance visa). It takes some time to do everything you need to do, but in the long run it is worth it. You don't have to hire an attorney. Just do exactly as the K1 visa requires as it requires. Many of the forms will seem redundant, just be patient. What would you do if you married and then he was deported back to his country? This is why you want to do it the right way and file the K1. Go to the ins website and download the form. He will need to return to his country and complete some paperwork and get a background check and physical. I know what I am talking about as I too am married to a man from another country. We did it the right way. He was able to get work when he finally was able to move here and after we married. Just follow all the steps and you will be fine.

Be so CAREFUL.

They have done many documentaries on men or women in this country marrying a person from another country. It rarely works out and here are the problems:

What would you do if he want to go home to his country. Go with him or he leaves you and your kids.
What would you do if you marrry him have kids and then he kidnaps your kids to the other country. It happens more often that you think and it is almost impossible to get them back.
Be careful, many men from certain countries in Middle East or Eastern Europe believe the women is beneath them. Many beat their women too. It is accepted there.
This person could be your perfect partner until you marry then he could turn into someone you hardly know. It has happended. They know how to charm the American women.
Does he have money many time you will not have access to it.
If he goes back to his country you get no child support.
Keep in mind depending on what counry many of these men believe in very large families.
Is his religion the same as yours, if not, it wont work.
Can he speak English fluently?
Remember his country sides with him in a dispute with you and your counry will not think it is urgent.
Also, could he have another family in his country and hiding it. This is very common. Even the Mexicans. Many Mexican men have several families and think nothing of it.

Please talk to others familiar with marrying a foreigner. Talk to a lawyer and make sure you check him out. Dont let your heart lead the way, use your head.

Follow kms40719's advice, she is correct, you need to file the K-1 visa first.

It is ILLEGAL to enter the US on visitor visa with the sole intention of marrying and remaining in the US. If it was simply that easy the US would be even more overrun with immigrants!! If you do it this way, be prepared for a long and difficult immigration journey. It will be on your fiance to prove to USCIS that he didn't enter the US for any other purpose but for pleasure and had every intention of returning to his country upon the expiry of his visitor visa.

You need to do things the proper way, that is why USCIS has a Fiance Visa category for exactly this purpose.

I strongly suggest you contact the INS to find out all the correct steps, but I believe that you do need the 'fiance' visa before you can make it all legal.

I sure hope you know what you're doing, and that you know this guy really well. As in, you've met him face to face before and this isn't an online romance. Those...generally don't end well. I've had those in my family.

Why are you marrying this man? If it's not deep, committed abiding love that you anticipate will last a lifetime, don't do it. Sounds like you're asking the wrong question here, missy.

Just go live in his country and make it easier on yourself. If you met online that will really look bad in the interview with the INS.

congrats to you and him. it really don't matter when you see lawyer. just as long as you get him legal. maybe you should call immigrations to find out for sure. good luck. and again congratulations.
