I went to a pizza buffet last night with a friend of mine. I asked for a booth because I don't do well with regular wooden chairs because of my size. However, none were available. As soon as I sat in the flimsy chair, it broke. Now the owner wants me to pay for it. I don't think I should have to because I asked for a booth. What do you think? I want to do the right thing,

You are not liable for an accident like this. Yes, you did ask for a booth. Flimsy chairs are not your problem, it is the owner's. He/she should consider himself lucky that you did not call police to report the accident. His/Her insurance would have to cover your costs if any, then hefty deductible would be a deciding factor in buying new chairs and offering "complimentary" dinners to customers that have accidents in the restaurant.

Don't you dare pay them a dime! God bless you for wanting to pay for damages. You have a sweet heart, but they have a rotten attitude.

If you asked for a booth and they sat you in a chair, they are responsible, although you could have waited for a booth to become availible. Honestly, it doesn't matter how big you are, they should have chairs that will support you. You sit in chairs at home don't you? Threaten to sue them for not having appropriate chairs for you. Being overweight is generally considered a disability these days. You may actually have a case to sue them if you wanted, but the threat should be sufficient to cause the owner to forget about the chair.

I do not think you are responsible for the chair - like you stated, the chair was flimsy. If a skinny person had sat on the chair and broken it, I think the owner would have been apologetic.

The fact that you're heavy does not give the owner a reason to take advantage of you - he probably did that because he thought you'd be to embarrassed to stick up for yourself.

If he tries to bully you, tell him you were at his restaurant and he's lucky you're not pursuing damages from him.

I don't think you should have to pay for it either. My husband (regular sized guy) sat in a chair at a restaurant and it broke underneath him. The owners were very apologetic and nothing more was said by either party. Having things break in business is part of doing business. Stuff happens. Consider it their loss.

SORRY BUT NOOOOOO IS NOT YOUR RESPONSABILITY, BECAUSE IF YOU ARE LITTLE OVER WEIGHT AND EVERY BODY NOTICE THE RESPONSABILITY OF THE PLACE IS FIND A PROPER BOOTH TO YOU AND COMPANION. OR IN THIS SITUATION, ALL BOOTH WAS NOT AVAILABLE THEY HAVE THE DESICION TO ASK YOU SR. ALL ORU BOOST ARE NOT AVAILABLE IF YOU WANT TO WAIT ABOUT....... WE CAN MADE THE ARRAGE TO HAVE ONE.

BUT THEY DIDNT, SO IT DOES NOT MATTER, A LONG TIME AGO THAT HAPPEN TO A PERSON SHE WAS AT THE BUS STOP AND ANY DRIVER STOPE TO PICK HER UP SHE TAKE THE LICENCE PLATE TO REPORT THIS SITUATION SHE WAS THERE FOR 7 HOURS THATS SAD, SO SHE CALL A TAXI AND THE TAXI DO THE SAME AT THE END SHE CALL A NEIGHTBOR LATE AT NIGHT AND SHE CAME TO PICK UP HER, WHENT SHE CALL TO MAIN OFFICE TO OPEN A REPORT FOR WHAT HAPPEN THEY SAID SHE HAVE TO LOSE WEIGHT AND THEN SHE CAN USED THERE SERVICE, SHE SUE THE COMPANY AND YOU KNOW WHAT SHE WON THE CASE.

REFUSE TO PAID IS NOT YOUR PROBLEM THAT THEY NOTICE AND I THINK THEY KNOW THAT THE CHEAR WILL NOT RRESIST YOUR WEIGHT.

YOU MENTION THAT THE CAIR IS BROKEN, BUT DID YOU FELL FROM THE SIT? DID YOU HARM YOURSELF? THATS WHAT THE PLACE HAS TO ASK YOU, THE EMBARASING MOMENT BECAUSE FOR BEING NEGLIGENT( they employes and the manager)

WHAT CAN GUARATEE THIS ACT WAS NOT MADE ON INTENTION.

I think the responsibility lies solely with the restaurant. It is their responsibility to ensure their environment is safe for patrons. In fact, since they totally disregarded your request for a booth and made you sit in a chair anyway, they owe YOU for the hurt and embarrassment you experienced. It was their negligence and total disregard for your well being that caused the whole problem.

Large people don't sit in booths and usually always ask for tables.
But the answer to your hypothetical question is no. No matter where you sit they are responsible. Even if you got a both and broke it. They are responsible.

No. The booths are made for customers and if it was to weak or already broken that is the owner's problem. You shouldn't have to pay for it, no matter how large you are.

Tell him/her where to get off.

I would fight it. They should accommodate all there patrons, and they should take into consideration that not all are built the same. So they should have more sturdy chairs, especially if so many people have weaken them through time. And it was just a matter of time for this one to go.

If his flimsy chair caused me to fall on the floor I would be suing his ***. Of course you are not responsible. He is just being a jerk.
