If a father has custody, that could mean you are in a situation that is not good for raising a child.
How much do you drink? Do you abuse drugs? Do you smoke? Do you have a live-in boyfriend? Do you have a job? These are factors that weigh against a divorced mother when the judge awards custody.
Boys raised without full time fathers in the home often grow up with severe social problems. Boys without fathers are more apt to do poorly in school and drop out. Boys without fathers are more apt to get into trouble with the law as juveniles and adults.
Many judges are now taking that FACT into consideration when awarding custody.
Frequent phone calls will only irritate your ex-husband. Harrassment will do your case no good.

Call a lawyer, we have no idea why father has temp custody. You had to walk off and leave your son with the father. I'm sure we would all hate to give you advice and find out you was not able to take care of him, or worse we give you advice and your ex gets your son because of something we said. Good luck and call that lawyer today. I'm sure it will cost a lot but to get your son back cost should not matter.

Well there is a reason that your sons father has him...
Start by getting your life together and then go the legal route.
And then if nothing is legal then you have ever right to go and get your son.
When you say that you signed a paper is it one that you and he made up? That holds nothing but if it came from the courts then that is something.
Before you go and up lift your child from the love and care of his father you had better make sure that you are ready to be this boys mother. No and ifs or buts.
And if your not you need to leave him right where he is because it sounds to me that he is happy and very loved there.

I came from a broken home and I know how painful these things can be. But you aren't providing enough information for anyone to give you a meaningful response. For instance, you say "my sons father" without explaining where you fit into the picture. Is this his biological son? You also don't give any information as to how you got into this predicament in the first place. This would drastically affect how you'd want to pursue the situation.

If it has anything to do with how you wrote, spelled and phrased your question and your statement following. . . . . I can almost see why he has custody. (that was terribly written)
Maybe go back to school and get some more education, then get a good lawyer and fight for your son.
Men who just out right take children from the mothers, to me are just plain cruel, mean spirited and thoughtless . . . . unless it is a case of drugs, physical, mental abuse or some kind of neglect.
