If you want to create a new operating system, start from scratch. If you use any Linux code, that would be Linux, now wouldn't it?

Your question itself is wrong. You want to copy the source code from somewhere. So your question should be "How to copy software for new operating system".
Plz dont try to copy something from somewhere. That wouldnt help u in any way. Just start from the basic and create a OS of your own.

I think you mean to modify LINUX to have a flavour of your own... Am I Right? If this is the case try:
1. http://www.kernel.org : Get the latest kernel source code.
2. http://kernelnewbies.org/ : Kernel tinkering FAQs & Tools.
Kernel tinkering is realtively easy, but If you really wanna create a totally new OS, you gotta start from scratch and code all the things yourself... its pretty hard and requires extermely good knowledge of hardware as well as software.
