my soon to be wife / fiancé is a resident alien, we've been dating for almost 2 years, I can see her as my wife and things are going well... she'll need to leave the US in about 8 months if we aren’t married... now, what I was thinking is that we go ahead and get married but make it just "legal" like with a prenuptial agreement to keep our assets separate... no big ceremony because we both live in Hawaii with parents all over the world. This would be for convenience and would be treated like an engagement mentally... and then when we relocate in a year or so we would have a ceremony and have the families come when its easier... I know it’s not traditional and I don’t want to cheapen the experience… but we love each other and want to make this an easy transition, and under the circumstances this feels ok... any suggestions on how to make it go smoothly? Legal advice? Just don’t want to rush in, but I still want us to be together... thanks.

I'm actually not certain if the correct term is resident alien... she came as a student from malaysia and graduated this past sept... she now has one year to work from that point. before leaving.

If you are a US citizen you can sponsor her through marriage and the process would take from 6 to 8 months for her to get her Green Card, the best thing is that you sound you have a legit relationship and if that's the case you shouldn't have any problem getting approved, so she don't have to leave the country.

Good luck!

My suggestion is yes, it is 100% alright, if you are does it for love. Some people may not support the idea, and some may look down on you. But the point of matter is your doing it for love and not just to make her legal.

If you where doing it to make her legal then i would have to disagree with you. Do what you need to do to be with her, even if you have to leave with her. There are somethings hard to find in the world, and if she is someone you want to spend the rest of your life with then do it. You will be loosing something very very very good and hard to find again.

If she is a resident alien then why will she need to leave the US in about 8 months if you aren't married? A resident alien can stay for life, UNLESS she did something illegal!

There is a good chance she isn't telling you everything!
