The cops came and filed a police report. I called the insurance company today and they said they have to send out an adjuster to determine liaility.

According to the cops who came, it was 100% my neighbor's fault since my car was parked. And there was a police report and everything, which the insurance people have. So why are they still taking so long to determine liability?

Can the adjuster come out and refuse to pay for whatever reason? We have easily like 10k worth of damage on our vehicle due to this accident.

No... it is a porsche cayenne. and you should see the damage. they backed into it with their suv.... so hard that their back bumper fell off!

10k worth of damage from someone hitting your car while backing out? Uh... what is it, a rolls royce? LOL edit: Ohhh a Porsche.. no wonder! :)

Insurance always will take forever and try to get out of any claim they possibly can, but since you have proof it's not your fault don't worry. You'll get your money.

More than likely it's just formalities: following procedure and protocol.

It sounds like you have nothing to worry about as far as getting your car repaired. However, looking at it from an objective point of view, there are some variables to consider (since you indicated your car has not been fixed) such as, have you ever filed a claim for this type of situation and does anything seem like fraud may be involved to indicate a need for further investigation; whether your neighbor is disputing the claim, for example your neighbor could possibly claim you were parked illegally; does your neighbor's insurance have adequate coverage; whether or not you and/or your neighbor are insured with large or small companies; the weather in your area, i.e., is it snowing so the adjuster is backed up, etc.

Your police report the best piece of evidence you have. The best thing to do is call your agent and get detailed information as to what the status is, they should tell you whether or not the claim is being disputed. If you're not satisfied with that answer, call the claims manager and let them know you want to know why there is a delay. Consider things such as: are you being prohibited in traveling, for example, do you have a rental?, do you have to take the bus to work because your car is not drivable?, and address these with the claims manager.

She is responsible, not you. Where you parked is no matter. She is trying to intimidate you to not make a claim. My wife bumped my neighbor's car parked on the street. He got his buddies at a paint shop to give him a claim that the paint repair would cost $600 for a tiny smudge. I filed a claim, I had to pay $250, insurance paid the rest. He never got the car fixed, just wanted my money. Over the next three years, insurance raised my rates by over $2000. I should have just paid him. Anyway, get her information, file a claim. A police report is not necesary. Hopefully you have a witness on your side. You could also file a complaint with the city that the cop intimidated you. It would be something that you have on record if thing ever went to court by the insurance company, however, usually they just pay because it is much cheaper than investigating and having a hearing. I'd say get the info, & file the claim.

It could be a number of things. Sometimes even on these clear liability cases there are issues that come up that have to be looked into, and people don't always get paid within 24 hours of the accident happening. Give them some time, and ask exactly what the issue it. Have some patience, and determine what the problem is, and go from there. If you're not happy with what they're doing use your collision coverage with your carrier. Yes, I know you feel you shouldn't have to, but that's what you're paying the premium for, you can get it fixed asap without any waiting, and then your carrier can go after the other person's insurance and you're out of it.

Get an estimate of our damages, present the bill to your neighbor. If the insurance pays him back for what he pays you, good for him. He owes it to you since he damaged your property. Keep on the neighbor, he will then keep on the insurance company to get it settled.

Insurance companies hate topay out, they are looking for a loop hole.
