My ex-husband is always following me and passing by my house several times a day and my sister's house also, is it enough for me to call the cops?

I live in TX and my sister lives about 4 blocks away from me. and he has no business being on the side of town i live in. also about 3 weeks ago he called me at work at started to curse at me over the phone.

FIle a police report. Texas has stalking laws. If that fails you can get a court order through your divorce which will keep him from coming near. Good luck.

If you feel threatened, yes it is enough. Each state's laws are a little different on how to file the order. Call the local police station and ask how and where to do this.

Even if you do not end up filing the restraining order you can give the details of his harassment to an officer in person and the report will be on file in the event that his actions escalate. You can request for additional patrol on your street. This can be used in court.

Has he threatened you verbally? Done anything to intimidate you? Do you or your sister live on a busy road or at the end of a country lane....all of these questions will come into play when requesting a TPO. Just driving by, especially if he can say he was on that road for other reasons, will not be enough for the police to intervene....but to be on the safe side...call them...it does not cost you anything and it may be that they can find enough reason to issue the order...(actually a Judge has to issue TPO) but you know what I mean...and if you are afraid...do not be anywhere by yourself if you can help it...Good Luck...

That would depend on the state you live in, most states today have stalking laws and if he is doing the things you are describing he is violating those laws, you can have him arrested for stalking and then file for a restraining order, without an arrest it would be difficult to get a restraining order. Some states have civil restraining orders but you would need to consult an attorney in your area to see if it would apply to you.

You have to go to the court house and apply for an EPO (emergency protective order). My EX did this same thing to me. I worked 3rd shift. I caught him WALKING down the middle of my street one night @3 am. Scared me to death until I realized it was his sorry a**. He used to drive by CONSTANTLY just to see if anyone was at my house or not. When you apply you have to beef it up and say that he has made verbal threats to you,etc. You have to have witnesses that he is 'stalking' you if you try to get the more permanent order. When they approve the EPO it last for @10 days. After that they have a court date to see if the judge approves it for a Regular protective order (can't remember what they call that). The 10 day temp one hopefully is enough to scare him into leaving you the heck alone! My EX did that shi* to me so much I finally moved out of town. It won't be on your ex's record unless they do a more permenant one. Just act like your really scared of what he might do and they will issue that (the temp one) for you. Some guys are so stupid - they just can't get past you! Even if they are harmless it is SO annoying seeing them pop up here and there and everywhere!!

Texas is a right-to-carry state. If you do not already have one: run down to your local gun store; buy a .39 revolver, either a Ladysmith or Charter Arms Undercover; ask the nice folks at the gun store where to get the requisite training for your carry permit; get the training; carry your pistol at all times.

If your ex-husband breaks down your door, are you going to defend yourself with the piece of paper that the restraining order is written on?

possibly if you feel threatened. Talk to the county prosecutor & see what he advises.
