A "one man" company took my merchandise back in 2002 to re-sell, but never paid me back for it neither returned the murchandise. He was sued by another compnaies (similar case) in 2003 and pleaded guilty, but I didn't file a lawsuit against him back then assuming that that would be a waist of time and money.

find out if that guy paid when he lost last time. Check the record and see if he still owes. You need to check with an attorney or the law library or go there yourself, and find out what the statute in your state is for bringing a lawsuit. But if he didn't pay last time then this time would be a lost cause. You'd have to pay filing fees. And if they owe you under $1,000 it's not worth filing. Remember that your time is valuable. If you waited this long why not just move on and chalk it up to experience and check out who you deal with better in the future.

Each state has different laws concerning the time to file a lawsuit. If you have not been in contact with him since 2002, my guess is that you may not be able to do anything. Most states will likely require something to be filed within about a year or so. However, each state is different. You didn't mention the amount of the claim. If it is under $5,000 it should come under small claims court. So, I suggest calling your local courthouse and talking to someone in small claims court. Any clerk can probably tell you what the statute of limitations is in your state. They can tell you what is needed in your state if you want to pursue your claim.
