My friend was driving and hit a car after my other friend grabbed his nuts and he was pushing her away. After he got in the accident, he switched seats with me. Now the girl that grabbed his balls told the police I was the one who was driving, and since the driver is saying the same thing to the cops, I now face a "Leaving the scene of a motor vehicle accident" charge which will result in me losing my license, going to a juvenille detention center for up to 30 days, and getting a fine of up to $1000, not to mention sky-high insurance for the rest of my life..

What should I do? Is there any way I can get out of this in court?

This was the driver's car. We switched because he didn't have a license. This is in Minnesota. There was another witness in the car that said he was driving, but the cop was yelling at him telling him to quit lying, so he changed his story and said I was driving. He said he would change his story again but it would sould like he is lying.

Also, my friend drove a block away because I refused to switch with him. We switched away from the accident because he talked me into it. We went to the gas station a mile away, and switched back to him driving.

The owner of the car is responsible unless he gave you permission to drive the car. The witness who changed his story can repudiate it and tell the truth in court as a witness for you and tell why he had to change his story because of the officer.
You may be able to pursue legal action against the actual driver and the girl who actually caused the accident in the first place.
Consult a lawyer,if you can't afford one,the court has to get you one and time to prepare.
I also agree with other posts,you were wrong to change seats and you need to get new friends.

Too bad for all the lying,
No lie= Here (Ontario,Canada) there is only a fine for driving without a licence (about $250) and maybe a careless driving charge (265) total about 500 bucks.

With lie=pay for lawyer(1000+) + fine+criminal record (priceless).

If you can get everybody to tell the truth to the police (if they believe you all) then you will probably get out of the accident charges but will then be liable for a charge called public mischief or obstructing a police officer charge, but will keep your licence. Either way.....Get a lawyer and get real advice.

First off I hope you realize how stupid what you did was. You may have felt like you were helping your friends out but what type of friends did they turn out to be. Well this is the story they have given the cops. They haven't yet given it to a judge under testimony. Perhaps your lawyer can explain to them how much more serious lying under oath is then to simply take the rap for this incident. Also you did leave the scene of the crime, since it was you who drove off.

Go to court, take your witness with you,

get the other people to change thier story and tell the truth.

Change friends that would lie on you, and let you get the punishment.

But when you changed seats, you basicly agreed to take responsiblity, since that was what changing seats does, so what did you think it would do when you chagned seats ???

You made a bad decision and it sounds like your friend is willing to have you take the rap. Sounds like you might be looking at some trouble since your credibility is shot since you already lied.

If your so-called friends are going to continue to lie then it looks like you are stuck. Still get a lawyer and fight. He can help with questions such as whose car was it .

If your friend was caught driving without a liscense,think of how much trouble he would really be in.
