and it is completely broken is there anyway I can get my money back.

Contact the seller and see what happens there first.

If you contact eBay they'll just ask what the seller said about it.

Threatening a member with negative feedback or insulting them usually stiffens their resolve and makes them less accommodating and cooperative. While leaving negative feedback is sometimes appropriate, resorting to harsh measures too quickly can make the situation worse than it is. Try to use negative feedback as a last resort.

Look for creative solutions. Think of solutions where both you and the person you're trading with get what you're looking for. Believing that any gain for you is a loss for the other side leads to a combative, me-versus-you situation. Instead, think about common goals you share with your trading partner. If the seller sells the item at a fair price and the buyer gets something they desire (which was why both of you came to eBay in the first place) then both of you go away happy.

Remember the broader picture. Instead of getting caught up in the emotions of the moment, remember this is just one transaction among many more to come in the future. Looking at the situation through the eyes of the person you're trading with may help you understand the perspective from the other side. Sometimes the "winner" can really be a loser in terms of wasted time and negative feedback. Keep your perspective and you'll be much better off in the long run.

Customer satisfaction is good business. Sellers, sometimes being accommodating to your buyer can be good for your business in the future. Research has shown that buyers are 10 times as likely to spread word of a negative buying experience, as they are to talk about a positive buying experience. Buyers are more loyal to sellers that they've worked with to resolve transaction problems than to sellers where no transaction problem has occurred. Consider your reputation as your most valuable asset.

Have you contacted the seller? Was there a notice when you won it that you should insure the article or the seller was not responsible?

First email the seller and explain how you received the item and ask 'politely' if there is anything that they can do to help you? If they are negative, DO NOT PUT NEGATIVE remarks in their feedback.. they will do it back to you... you may have to request a mediator.. there are tons of things that are available on Ebay just for things like this..

A lot depends on whether the seller was trade or a private individual.

Start by contacting the seller (via eBay) and let them know. If they can't come up with a satisfactory solution, use the eBay disputes procedure.

If it's a private seller and they won't co-operate, there's not much you can do except give them bad feedback - but go through the disputes procedure first.

First of all contact the seller, give them a chance to sort things out for you.

If you are still not satisfied and you paid through paypal contact them and explain the situation.

You can also contact ebay and complain and leave your comments on the seller

But give the seller a chance first

Oh dear - first you need to contact the seller and say what's happened. Either tell them you want a refund or ask them what they can do about it. Hopefully they will offer you a refund (they might ask you to send the item back). If they don't offer a refund - say you want one! If you paid by PayPal it's easier than other forms of payment. Give them a while and if you get no joy report them to ebay and leave them negative feedback.

Contact the seller immediately.
That is the very first line of defense. Also keep a carbon copy of that email, address it back to yourself, and send one to ebay as well.
There should be no problem I have known people who buy and sell on ebay,

If you paid by Paypal get in touch with them straightaway and claim a refund telling them first of the problem. Also get in touch with Ebay to log a complaint. It takes ages to sort out but you may get a good result.

I USE EBAY ALOT BUT IVE ALWAYS BEEN QUITE LUCKY. CHECK THE ITEM AGAIN TO SEE IF THERE IS A RETURNS POLICY FOR BROKEN ITEMS. ALSO CONTACT THE SELLER VIA EMAIL TO EXPLAIN WHAT HAS HAPPENED THEY MAY BE GOOD ENOUGH TO SEND YOU ANOTHER ITEM OR REFUND YOU. IF THEY WONT THEN CONTACT EBAY ITSELF AS IM SURE YOU ARE COVERED ON THEIR INSURANCE.

You need to contact the Seller and let them know. If they offered you postal insurance on the price of P&P then it should be covered by the post office insurance.
