depends on your municipal regulations. here (canada) if you live on a corner lot like i do, you may only have .75 metre height (29 in.) for 10metres (33 ft.) in from the corner both directions. this is so people in cars at the corner have an unobstructed view of pedestrians and traffic. after the 33 ft. you may go to a height of 1.9 metres (6 ft.) for the back yard and 1.2 metres (4 ft.) for the front yard max. however if you have a higher fence that was built prior to the regulations you dont have to remove it. but when its time to replace it you MUST find out from city hall what the regulations are and follow them or the fence can be ordered demolished at your expense. dont just presume that you can replace any fence with a duplicate----check first.

Bloody free loading Councils....

I would suggest have a talk to the council they probably only want their share of the job (Permit Fees). Or worst case scenario is they will want the fence height reduced if possible. Unless the fence is unsafe they won't tell you to remove it all together.

Good Luck

well depends on where you are, here in new jersey (usa) you dont need a permit if its a replacement.
whenever i get a "headstrong" inspector i like to check with other towns nearby to assis in understanding code issues, you may want to do the same.
