I was in a parking lot last and this lady hit my car, I went to get her info, and she asked me if I could deal with it without getting the insurance involved. So I agreed, and got an estimate, now she tells me I have to talk to her husband to get the money!! And what's worse is now she says that she is going through a divorce and that she can't pay the money because her husband is in control of her fianances, and she problem just sits around the house and has never worked a day in her life!! She left the number of her husband on my phone and told me to call him, like she is some child who can't deal with her own stuff. Why should I have to talk to her husband? I have a mind just to sue her lazy stay at home butt cause I have a job, and I support my family!

How do I deal with this so I can get the money from her and not have some random guy who I don't even know involved?

Go to the police. You still can file a police report! Then, call to your insurance company and ask them exactly what you should do next.

Call your insurance company and report it. They will track her down and find out who her insurance carrier is, and things will get resolved through the companies instead of through you and the husband. Don't worry - it won't cost you a penny and will not affect your record. Also, you will not get in trouble for not reporting it right away.

This exact same thing happened to me. I got tired of waiting for the guy to pay (gave him 4 months) so finally just called my insurance. Less than a week later I had a check and the car was taken care of.

Worst case scenario, she doesn't have insurance and you'll have to take her to small claims court. There's a chance she doesn't have a valid license, too. That could be why she didn't want to involve insurance in the first place.

I had a instance like that too a man hit my car and i was with my boyfriend then at the time not anymore anyways this man comes out swearing he will pay for the damage but betgged me please not go to his insurance as he has a fleet of limozines and they will up his insurance and he won't be able to afford to work and i would take his business away . so he gave me his address on his driver licence phone number and his business card. and my boyfriend said do it hun . and then the man pulled out his koran and swore on it once he knew my boyfriend was of the same faith and dsaid he promise he would look after it. so i said okay and i got the estimate and sure enough the business card the company was no longer there and the house he lived at he had moved over 2 mths ago and the phone number didn't exist and i was out of my own pocket to fix itl... moral of the story even though we are trustful people we can't assume everyone else will do the right thing. so lesson here nect time somone does this. no hard feelings buddy but i have to take care of myself too. just the way life is these days.

Did you file a police report yet? You have only 2 wks from the day of accident to file for report or else insurance will give you a hard time. Call your insurance and let them know your sitatuion is your best chance of getting your car fix soon. You may have to pay for the deductable first but having your insurance after the other people is less headache on you. I had a similar sitaution like yours 3 months. A teenage hit my car and I took down her info. She told me she wanted to pay for it out of pocket. I contact her for a month and she never called back. I tried calling her parents and they avoid my phone calls. I got tired of waiting and just file on my insurance..Yea i had to pay for the deductable but i got my car fix w/thin a wk. My insurance is sueing that gal trying to get my deductable back. It's been almost 2 months now insurance still after her.

First ...did you file a claim #..with police after the accident...and inform your insurance..??. if so.!. the simple deal is the lady does not care...and am sure ..its not on the lady husbands ..top 10.. go after the lady ..that hit you through the insurance company...thats why you pay them money each month...or take her to court.... as soon as you can...good luck..

I'm guessing you learned this already, but you should never forego the insurance company. It may seem harsh, but they are there to keep things like this from happening. Because you didn't get insurance involved at first your ability to sue her has been severely hampered.

The simple answer here is just hit her back. Literally or figureatively. Threaten her with a lawsuit, say you aren't going to jump through hoops to get the money (i.e. deal with her husband). Tell her she has to do what she has to do to get the money and it isn't your concern, all that matters is you pay her or you drag her into court.

Your insurance policy's uninsured motorist clause should cover this situation. Just turn it over to your insurance company and let them deal with it.

And drop the name-calling. Calling somebody a "lazy housewife" shows a lot of immaturity on your part. In your mind, is there something wrong with housewives?

I presume you got all her info. Simply report the incident to the authorities, and the insurance companies involved. How do you know she's not lying up her butt?

Tell the police first. Then the insurance company. If she refuses, get the police involved.

You should've worked to get the insurance info and called the police to the scene of the accident. You're lazy!
