my ex girl got a restraining order after a domestic disturbance and now wants to get it stoped but is afraid of getting in trouble with the courts for not attending the hearing what should she do?
// also she hasnt had the papers served.

Listen, are you sure you want to continue a relationship with a woman who filled out a restraining order against you?

Either you did a bad thing, and it would be gentlemanly to let her get on with her life.

Or she over-reacted, and she might over-react again. Maybe she should get some counseling.

Either way, you guys should probably take a break for awhile and re-think your relationship. A restraining order is a pretty big thing.

She can go back to where she got it and apply to have it removed, but if it was served by the police (they can do that in australia) then she has no say. The police stick to it to send the message home that the behaviour is criminal...too many people drop charges and then the same thing happens again. It would be a violation of the order if you are speaking to her now - when the restraining order is in place - so you can be charged for that.

There must have been a good reason for it. If it was against you, then you should get anger management counseling and she should go to court to explain why she didn't show up at the hearing. You must take things one step at a time but the proper steps. After your courses, then she should have it recinded if that's what SHE wants. It's the best way for both of you

Usually when one is granted the cops take it from the court and deliver it to the person. with the warning about what it means. In any case they aren't good forever. You have to go back every 6 months two a year and have another one slapped on. Or in this case Not!

Show up to the court date and let the judge know...that way it gets dismissed.

or

Don't show up, miss the date...and she MAY not be able to refile it again.

The only way is to have it withdrawed. Don't know for sure if she'd have to go to court to get it withdrawed or not.
