some police forces want laws passed that would stop motorists from using cell phones while driving. Police and their supporters argue that people who talk on cellphones while driving are dangerous to themselves and others. They point to a 1997 survey that showed more drivers in Canada were 4 times more likely to have an accident while talking on a cell phone.
a) Identify and analyze the issues raised.
b) identify which section of the charter could be used to protect individual rights against the proposed law.
c) justify your recommendation as to which direction the law should take.
Please help me out with these issues as I am trying to prove a point to the law.

Talking on cellphone while driving is dangerous because the concentration of the driver is diminished resulting to a possible accident. It is not a violation of a right but a valid exercise of the police power of the state to prevent accidents.

There are dozens of thing people do while driving that are dangerous. From eating while driving to applying make-up. Talking on a cell phone is nothing compared to some of the other things we do.

The problem is when the study was conducted. Back in 1997 people were still getting used to cell phones. I am willing to bet that most of those accidents occured while the person was answering the phone or trying to dial a number. Also I would be more impressed with the data gathered if the scientists looked into the other factors. What is the likelihood of causing an accident while using a cell phone? Did the study just look at all accidents and noticed that a majority of people involved in accidents just happened to be using a cell at the time?

Car phones have been the play thing of the rich since the 1970's. Did the scientists record the number of accidents caused by drivers in cars with car phones?

Hands-free devices like blu-tooth have been around for a while, why not make them required while driving and talking on a cell?

A. Is driving when on a cell phone dangerous.

B. call phones have come a long way and most have speaker phones that can be used or a head set. the point of a ban like this is to get people to pay more attention to the road instead of fiddling with a phone. if a speaker or head set is used at least they will have both hands on the wheel and not on the phone and its tiny buttons.

C. In numerous tests in the USA it has been determined that talking on a cell phone is equivalent to driving under the influence of alcohol. There should be a ban on the use of cell phones because not only are they in-dangering there life they are in-dangering the lives of others.

I have had 2 accidents (not my fault), in the last 5 years involving People on cell phones. The first was when some one drove Thur a red light while talking on a cell phone . The young lady was charge with failure to yield. The second happened 5 months ago. I was struck from behind by a man in a pick up truck on a cell phone. I spent 3 days in the hospital with back strain. The police later told me he was phoneing his connection for herion. That case is still pending. I have a cell phone but keep it off when driving. If I do have it on ( very seldom) i pull over & answer it.

a) of the accident scenes that I have witnessed, I have sometimes seen active cell phones in the wreckage of the cars. The survey is correct. It would be more effective if it was a facts based on events records.
b) The citizen has no rights, as long as the citizen allows a goverment to rule them and remains inactive, they only have themselves to blame for any wrongs done.
c) The law should become active, it is a fact that operateing a moveing vehicle and trying to play a game of gin rummy at the same time results in accidents. The focus and attention of the vehicle operator should be on the conditions that affect them and others useing the route. If cell phones,PDAs,Calculators,DVDs,Card Games Chessboard and whatever else are permmitted to be used while operateing a vehicle, then who has control of the vehicle?

I live in a place where driving using cell phones is already banned.

Statistics have indicated that a drop in traffic accidents have occured as a result of this ban so i'm also all for this law

I drive on the road a lot. People who talk on cell phones are distracted from driving, just as if they are eating, putting on makeup, etc.

I have seen how people drive too close. They are talking on the cell and are not paying attention to how fast they are traveling, how close they are driving.

I am 100% for banning hand held cell phones.

It has been proven that talking on the phone while driving is worse than drink driving (distraction wise). It is banned in Australia, you have to pull off the road if you need to talk. It is very distracting and stupid to drive and talk on the phone at the same time.

keep trying to do what you are trying to do,its comendable.but when it comes to time money and labor,saying it is one thing doing it is another.
