Lidia, Mary, there are a lot of stupid people living in the United States, but immigration officers are usually not among them. Your friend came to the U.S. and got a work permit. It expired. He filed a bogus claim of asylum and they denied him. If he now gets married to a US citizen they will see this as what it is: a way to stay in the United States and deny him again. If he files for AoS he will not only be denied, for obvious reasons, but this may go actually as far as USCIS involving a D.A. who then will offer your friend a way out without going to prison if he testifies against his fake bride. Since not many men like to bend over for other men in the big house, many take that deal after which they can leave the country and the US citizen gets convicted of immigration fraud, which is a serious felony, carrying an up-to 5 years in prison and up-to $250,000 fine as a reward for being so stupid. You may think about that, and perhaps inform your friend's fiance about what huge risk she considers taking.

you see the funny thing is that it's not that easy any more. see now you have to live together, be married for about 7 years, or have a family together. Not to mention still hire a lawyer to do all the paper work for you, and that just cost A LOT.
