been seperated 7 years living with new partner and have a 3 1/2 year old son started proceeding 5 years ago she wont sign them wont even talk about them what can i do now

After 5 years you can get a divorce without your spouses consent, as long as you have an address for the court to serve any papers to. I was like your wife, i wouldn't sign any papers because i was being a bi*ch. But then after 5 years when I wanted a divorce my hubby had moved to canada so i had no address for him. It then took me 11yrs to get it. Your wife is being foolish, maybe she doesn't like you getting on with your life but she has to realise that in doing this she isn't getting on with hers neither. Depends on the state in which you filed the divorce..
In most states, she does not have to sign them and she does
not have to agree to get a divorce...
Either spouse can divorce the other without the others consent, agreement or signature...
You need only file the divorce papers with the clerk of court and have a copy of them served to her....She has no choice...

You should not need her to get a divorce that is the beauty of have them lawyers they suppose to know this. If you have had a constable serve her with the papers she doesnt have to sign them after so many days it is granted to you any way unless you live in one of them states where you got to wait a year and by now it should have been final.

You shouldn't need a signature after this long. Call your attorney! About four years ago, he should have filed it in the newspaper. If she doesn't read it, you would have been issued your divorce by default. If she reads it - she'll bring her butt to court and contest it, but at least get the ball rolling. Call your attorney! Good luck! My ex wouldn't sign mine either, so I had to post it in the paper and wait 90 days for his "response"... It was posted in IL - he lived in TN LOL

get you a better attorney.There is no reason why you can`t get a judge to decree you free.You can prove your single and if she is not living with you by law you can get a divorce decree. You either don`t want one or your attorney like must are milking you.When you find an attorney that will get this done then sue the other for Mal practice.Write a nice letter to the bar association that will cook his goose

I'm not an expert but I'm sure you don't need her signature as its been more than two years. Get a decent lawyer as it seems she is just being spiteful. She has her own life now. She shud let you have yours!!

I never got a sign. from mine, and still got divorced in a default divorce. Its where I filed and he never responded with a lawyer.

after 7 years in the uk (not sure if you're a brit or not) you are officially divorced anyway as far as i can understand; one of my good mates has been in these circumstances and after 7 years he's officially seen as single as far as i know. talk to your lawyer if you've got one
