I have a sect 8 family that had a year contract which has been up for a few months. I need to teminate the tenants and get new ones (need more rent, they are damaging the property etc) I called HUD and they say I give them a 90 day notice to move. 90 days is way longer than I want as I am afraid they will destroy the place. Can I legally get them out sooner and if so, how. It is in Long Beach Calif.

Check the lease with HUD, you should have two leases one with the tenant and one with HUD. Once the original term ends then it goes to month to month. if it is 90 days, then that is how you have to wait, the other option is to raise the rent and give notice according to the terms of the lease. When HUD fails to pay the new rent then you take the tenant to court for failure to pay. If it were me I would do both, raise the rent and give them notice to move, I wouldn't hire a lawyer as you will be wasting money, trust me the government has more money and time than you do. i was tied up in court for 6 months with a lawyer and didn't get the tenant out until i raised the rent and HUD failed to pay. A very expensive lesson.

Hire an attorney. In my state after a lease expires you are on month to month and under no obligation to extend the lease. I would not go by HUD, hire a competent lawyer TODAY! Section 8 renters suck - I would never allow my properties to rent section 8 - You are almost always guaranteed a head ache, and a HUGE repair bill IF you ever get them out.

If they haven't paid the rent, you can evict them sooner. However, since you went to the source, I would heed their advice.

terminate happens when the lease has

expired. why are they still in the property.


have you allowed them to stay illegally
