Hi, if the tree roots are damaging your property (this includes the garden) technically it is classed as trespassing as it is on your property and it is also causing a nuisance. The council should act if they own the tree or it is on their property. Tell them you have rights under tort for nuisance under the occupiers liability acts. Speak to the planning department. Have you contacted your council? We have a tree at the other side of our fence which is higher than the houses. It was over growning into our garden and stopping the sun. I contacted the council, explained the situation and within a couple of days they had it cut back. Its roots are growing under our fence but luckily it is causing no damage it is just a pain when i try to plant my flowers and there is big roots there. Good luck

The council should maintain the tree so that it does no damage to your property, contact them and ask them to deal with it. If the refuse then a dark night and copper sulphate sounds like a good option...;

You need the advice of a solicitor
Was the tree causing these problems when you moved in OR has the tree grown to cause this situation whilst you have lived there,if it is the latter you have a case.

tell your council about your problem they will do a very good job of ignoring you and then try to fine you for giving the tree a hard time then raise everybody tax to make the tree happy again. good luck

.it depends on several things dose the tree have an preservation order on it (nothing can be done to the tree un less it's dangerous).but you can remove any branches that over hang your property roots can also be trimmed but you can not coarse to much damage to the tree other than that consult a qualified tree surgeon

Copper nails do wonders for making unwanted trees go away. It's a slow process but it works. If you are a bit more impatient try a judicious application of Copper Sulfate.

drill a small hole and fill it with acid, I don't remember which kind, but there is a kind of acid that will kill a tree from the inside out. Once the tree is dead, you will win, either they will have to remove it or it will fall in the street or on your house, in which case they will have to fix your house and remove the tree.
