My father smokes in home and I fear for my health. Can I sue him if he doesn't stop smoking at home, after warning him I will test the law? Will this constitute as child abuse?

Oh and how can I persuade some politicians to enforce such a law. Maybe we can all sign a petition.

not as far as I know...it's not illegal to smoke inside your home.

If you had my vote, I would say YES...but I don't make the laws, so I think you're stuck with the 2nd hand smoke.

If you want to try something, try convincing your dad to smoke outside, or at least near an open window.

You can sue anyone for any reason you wish. Doesn't mean that you would win, or ever see the inside of a courtroom. Maybe it would be best to try to work out a compromise by actually discussing the issue with your father.

in a way it would be, as it is harmful to you. in fact, 2nd hand smoke is more dangerous to the other person than smoking is to the smoker. mabye you should try to tell him about the dangers of smoking and tell him that if he really cared about you, he'd stop. encourage him and support him, as giving it up will be hard for him. you can sue him all you like, but i doubt you'll ever get to court. i feel really sorry for you and i understand how you feel. i have allergies to smoke and i have asthma.

polititians don't care what minors who can't vote will or won't do.
Honestly, they worry about people who vote.

next this is your fathers home, I am sure a nice bed at JUV detetnion for a month or two may make you respect your parents and your home.

Obviously they needed to take you to a wood shed a few more times, you are about the most disrespectful child I have heard on here in a long time.

So leave the room when he smokes, it is his house and no it is not considered abuse ( I don't beleive in smoking, but you have no right in the matter at all)

nope it's not child abuse. I wish it was. If he was smoking dope and taking care of you, or if he was drinking while caring for you, those could be neglect. But cigarette smoke, not yet. Even though really it's quite neglectful of him to expose you to that nasty second hand smoke

in a way yes because your dad's non-stop smoking is a big health hazard to all your family members living in the same roof.
