It's not a joke, it is actually true. If you were caught passing it to each other, it counts as both posessing the spliff or joint.
Then there was obviously a double meaning that they overlooked, as it is quite literally posessing a joint.

that sounds more like on a play on words for "joint posses ion" which is much like "tenant in common" as ways of having real property.
