if the punter fumbles then kicks off the ground it will be classed as grounding so the receiving team will gain control of the ball from the place he kicked it from he would how ever be better off try to pick it up to run it or even pass it as this is 4th down and the punter can throw or run the ball as a trick play

I would think this would be considered a drop-kick.
If it were to go through the uprights, it would count as a field goal. If not, it would count as a missed field goal.
I remember when Flutie did the last dropkick in the NFL, and all the old school TV analysts knew what a dropkick was, when most people had no clue.

Ok, here's the real scoop. The punter can kick, or punt, the ball after a fumble. If an ineligible player leaves before the punt, he'll be flagged for ineligible downfield. Punts are timed by the linemen so they know when to run down field. If the ball isn't punted in that time, that's when that penalty is given. The linemen aren't watching the punter or the ball so they might not know the ball has been fumbled. The only players that can release downfield before the ball is punted are the players wide on both sides. Did this clear it up for you? If not, here's a list of all penalties. The one I'm talking about is number 21 under "Five Yards".
