hi,
can i get FORM-16 from a company where i served 6 months ?
the company cuts tax every month from the monthly salary slip.

can i get the FORM-16 for 6 months ?

suppose, if you work in company A for 6 months

and then you work in company B for 6 months ?

then how do you file your tax ?

dont you need 2 FORM-16 ? one from company-A for 6 months and other from company-B for another 6 months ?


Otherwise whats the document needed from company-A ?

i am confusing ,

if i leave a company after 6 months , should i tell them to provide me a FORM-16 or Income Tax Statement doc ?


obviously, the second company will provide a FORM-16 for the rest of the 6 months .

But i am worried about for the first company , should i ask them to provide a FORM-16 or an Income Tax statement doc for 6 months ?

Form 16 will be issued after financial year end. You can work in two companies. In this case you will get 2 Form-16 and you can submit those two forms at the time of filing returns.

At the time of filing your returns, if the two companies put together have collected more tax than what you have to actually pay, then you can claim for refund. If you have to pay tax, then pay the tax at the time of filing.

I did not understand as to why you require Form 16 for 6 months?

The Form 16 is an annual statement. If during any financial year you have worked with 2 companies, you will get 2 Forms each for the same year. Both the Forms will bear the same financial year but while giving details of payment made to employee these will inform various periods and amounts pertaining to respective companies. Any way you have to file both these forms along with your Return.

Form-16 is issued under Income Tax Rules. Such Rules specify that the form has to be issued within one month from the end of financial year. i.e., March. In other words, your employer is not liable to issue form-16 until April 2007 for Fin-Yr 2006-07.

So, keep waiting till that time..However u r entitled to ask for "Income Tax Statement" which would specify what has been your Income & Tax working for the 6 months u have worked.

Answer to your question is simple.

Did they deduct tax at source from your salary? If not, they are not bound to issue form 16. However, you can get a certificate of salary which will show how much salary was paid during six months.

Remember, if no TDS is there , employer is not bound by law to issue TDS certificate. IF TDS has been done, they are bound to issue within one moth from such TDS u/s 203 of the I T Act
