If the illegals are put in prison, that would be illegal for the U.S. since they belong to Mexico or whatever. Explain please.

And a person would break a law for deporting an illegal person. Look at Amendment 14, you have to read it alot of times to find this fault.

If a person has no identification papers they are held as a "john doe", and until they can run a finger print confirming their identity through Interpol they can not release them into the U.S or put them back into Mexico unless they have Mexican ID. what is their Salvadorian nationals or Hondurans. Anyway after some check on wants and warrant the person is identified. If they haven't committed any other crime except trying to cross the border illegally, which is a US crime in and of itself, they will deport the person back to their place of origin (birth). If they have committed a crime that prosecution is mandatory then the end up getting a prison sentence anyway and then get deported.

All countries have the right to enforce the laws within their borders. This includes detaining anyone that breaks the law. An illegal immigrant is by definition breaking the law just by being here without the proper documentation, hence they should be detained to protect the citizens until arrangements can be made to deport them.

Being a U.S. citizen does't protect us from being arrested in a foreign country if we break their laws so it is only fair that foreigners that break our laws are subject to arrest.

The problem isn't that we're arresting illegals, that's enforcing the law. The problem is we're not enforcing the laws against companies that hire illegals that under cut American citizens and turn a profit at their expence. Forget fines and penalties, if you pass policies that actually allow for the arrest and direct imprisonment of those hiring illegals, then the things will definately improve. Since these employers won't want to go to jail, they'll stop what they've been doing. Illegals will have less incentive to come here and those that are here will either leave or seek to become proper citizens to live and work here.

Perhaps Mexico and every other country should be asked that.

Does Mexico have the right to detain an illegal in their country? They do. So now what? Are you saying it's OK for every country to detain illegal's, except the USA? Protest Mexico, Canada, the EU, Cuba, etc. they do the same thing. Why are you only against the US doing this?

if the immigrant broke a law here they can do it. the usa has agreements with most countries on matters like this. If you break the law here and are illegal the countries work it out and it does not happen quick. I know because I transported these captives for several years.

If they break our laws while in out country, legally or not, they are subject to our laws & punishments.
Otherwise, anyone could go to another country and commit any crime they wanted with no consequences.

I don't believe that deporting someone here illegally would violate the constitution at all.
Deporting a citizen would be problematic.

US can hold an illegal immigrant because they are ILLEGAL!!!
If they belong to Mexico or another country, then why are they coming here ILLEGALLY??? Why don't they go through the propper channels to become a US citizen?????????

When you are in another country, legally or illegally, you are subject to that country's laws. If you take a trip to France and break the law, they are not going to fly you back here. They will imprison you there.

No. They are here, we can put them in prison.

They put our people in prison if we break the law there, too.

And the 14th Amendment has no bearing on deporting non-citizens.

I think you need to explain your question, please.

The US federal authorities have personal jurisdiction over all persons within its terroritial borders, with the exception of foreign diplomats, in applying federal laws.

Jurisdiction applies even to those who are undocumented (or illegal) immigrants.

So they can pay for their crime. They committed a crime against USA, so USA will punish them. If you return said illegal to their own country, NOTHING happens to them, and they just return to USA to re-break our law. Very simple and correct reasoning on USA's part, I say.
