Is a company allowed to with hold a paycheck if you leave?

Only if for some reason you owe them the funds in that paycheck. If your paycheck is not made available to you in the same way it was when you were employed, they are breaking the law. BIG TIME.
Is it a settlement? A settlement, paid as a 1099 and not by a w-2 where taxes are deducted and 1/2 of FICA taxes are paid by the employer are not the same. If you are paid by 1099 and are a contractor your settlement can be held for up to 90 days in order for the payee to determine if any of that settlement is owed them.
