I understand that most likely an illegal immigrant would be deported, but I am interested in what the process is. Do they get jailed? If so, for how long? Do they get a hearing? Under what circumstance would they be allowed to stay? Thanks!

They're arrested, detained and then given a hearing to establish if they have a legitmate cause for asylum. If they don't prove their case, they're deported.

Depending on their situation for being detained.

1. If they committed a crime they will serve the jail time here and go to trial or make a plea deal or whatever the case. The regular jail is not require to report illegals to INS since no one is required to show proof of citizenship when detained in regular jail.

2. If they are caught by INS. They will be detained in the deportation center. They have a right to a hearing if they choose.
a. If they choose the hearing the are there to prove why they need to stay, deserve to stay, or have the right to stay. The judge will determine either immediate removal, voluntary removal, or they may have a right to stay (Visa).
b. If they do not choose a hearing and can not provide proof of legal standing in the US then they either get voluntary removal where they leave the country by a certain date or immediate removal which is most likely after being caught a second time and didn't leave by the voluntary removal date.

Voluntary removal is used so that INS don't have to pay to fly them back to the country the person is from.

Don't give me a low rating because you disagree with this comment. I am not saying that I support or not-support deportation. I am only stating the process.

When an illegal alien get caught by ICE, first they get booked, then go to jail and then deported. How long they stay in jail, that will depend on how many they have to be deported and the country of origin, now the government is deporting the illegals faster than before. They only get a hearing if they are caught outside of the border. Things are getting tougher for the illegal aliens.

The federal govt. wants us to believe they have stepped-up enforcement and stopped catch & release. This is not true - it's business as usual! There are only 1700 ICE enforcement agents for the whole US! A person is caught (ICE is now only going after child predators & murderers....they go in front of a judge, if found guilty of immigration violation - and in many cases this does not happen because ICE cannot find out their true identity..most judges will not deport someone without proof of identity - and of course the government only keeps records on Americans - no electronic fingerprints for illegals - it usually takes up to 2 weeks to get federal paper files from one place to another - we must protect their privacy you know! If they are found guilty they are put in jail until they can be flown back to their country of origin - it is a rarity for an illegal to actually be deported - our government has out too many loop holes in the laws. A good example is the woman in the church in Chicago - she hasn't been touched this time, she was deported once but came back to the US to have her anchor baby, this time she is set to be deported for Social Security fraud...but ICE has not fulfilled their responsibility & arrested her! How many Americans get off scott free when they defraud the government? In our country it pays to be illegal, paid for by middle-class Americans!

Very good question. This is what I know; here in L.A., they are taken to an immigration jail in the city of Long Beach. Then they wait until they have a bus full and then take them away. They can be in jail for quite some time, months even!

It depends if they are wanted in theU.S. and if they are, they will go through the legal process and do time if neccessary, and a detainer will be placed on them, which means that once their time is up, they will be released to INS for deportation back to their country. If they are not wanted then they will be fingerprinted, and photographed for future use, because they will be back.

well if yall wanna know the truth.they take prints of there rigth index finger.then they try to get info. about them.they tell them that they will not have a chance about gettin a green card or anything else that will get them legaliy into the u.s.a then they serve there time in jail take em to the border lead em to mexico.them they try to cross the rio grande to get to the u.s.a again.they neva give up. the minute man r there enimies wetbacks will kill them at any risk.there are ppl that help the mexicans get to the united states.there called coyotes...im a ******* thats how i know!!!!!

I like the first answer.....yeah, after they're caught they are rewarded with more government assistance - you know......all the free goodies that Americans aren't qualified for. Then they are given a brand new Hud Home to live happily ever after in the United States. The end.

If they get caught they used to send them back to their country, now that is considered a crime I am not too sure what happens.
