I asked this question before but the answer I got was stupid. My husband and I are getting a divorce we have a little girl. I have made mistakes in my past I cheated on him and I know that he knows that and has stuff to show the judge and the same time I have print offs from the net where he got on personals plus I havea phone recording well two saying he choked me and one saying he did it so I couldnt breath. I dont want my little girl around that but I know the judge will only take facts not name calling what are the chances he could actually get primary custody? (he said he is going to fight for it)

1) IT IS VERY DIFFICULT FOR THE FATHER TO WIN PRIMARY CUSTODY FROM A FIT MOTHER. Your having cheated is not enough to declare you an unfit mother, unless you neglected your daughter in the process or you brought your boyfriend to your house in front of her.

2) IT IS EVEN MORE DIFFICULT FOR THE FATHER TO WIN SOLE CUSTODY IF YOU CAN SHOW THAT HE HAS DEVIANT AND/OR VIOLENT TENDENCIES, which your tapes and or transcripts may or may not show.

I would NOT get too worried about it...obviously it's going to be very stressful going through all of this, but the odds that you will lose your daughter are slim to none.

Now, it's all about making her life the best it can be from here on out. No cheating, no putting other men before her, no using her to get back at her dad (no matter what HE does, and he most likely will do that), no overcompensating for her being a child of divorce. Live a better life. Make better choices. Both for her AND for you.

hmmmm, well, i don't think cheating on your husband could have a large affect on custody, but, i do belive that if there is a phone recording admitting that he choked you, custody would be on your side, so he couldn't harm your daughter in any way.

take the tape recordings to court and pursue the fact that he's a dangerous man..although it would be better if you had gotten a police report for domestic violence...and you could shoot for full custody but give the husband the weekends to visit...BEST OF LUCK I HOPE IT GOES WELL FOR YOU!!

the chances before court are always 50/50 but ovbiously things change when in court. just fight your cause as best you can thats all you can do. its hard knowing you have little say when it comes to the judge deciding but in the end youve just gotta make sure you know you did all you can. :)

If he has solid proof that you cheated he could get custody.
