The other night on I77 north a Kanawha County Sheriff police car was traveling about 100mph with no flashing lights on. He almost rear-ended a car in the lane. I seen him slam on his breaks. I was traveling at about 70 when he zoomed past me. Is this legal for him to drive this fast with no flashing lights on?

The guy in that lane that almost got hit would have moved over I'm sure if he knew it was a police car. I would have too. I just seen headlights coming up from behind me flying and as it pass I seen it was a Sheriff car. I understand that they can go fast if they need to get there quick even with out lights but this guy was on the Interstate going at least 100 not guessing because it was by me in 1/2 second. The lights wouldn't have gave away that he was coming like maybe on a city street. He is just lucky he didn't slam into the car in front of me in the left lane. Kind of stupid too I mean he was there and he seen it. If he had his damn lights on the car would have gotten over.

Many times an officer/deputy are dispatched to a high priority call without a given code response. Not every call is life threatening, and requires a code 3 response. But, many calls are urgent and require the officer to respond in an urgent manner, safely. I am not justifying bad driving by the officer, but 99% of people don't realize, that most cops aren't just speeding to speed, they are usually enroute to a call that requires a quick response.

There are those P.O.'s who think they are "ABOVE" the law, when in truth, if this particular P.O. had "rear-ended" the car in front of him, he would have a lot of explaining to do. It's not often, but if a citizen (or civilian) were to see and report an infraction being committed by a SWORN OFFICER, in most cases it doesn't just "go away", but is handled by Internal Affairs. The civilian would have to submit to a sworn affidavit in order for I.A. to successfully execute the complaint. It is best to have more than one complainant in an issue such as this. Corroborative evidence is hard to shoot down in any court.

No it is NOT. If he is in pursuit , or to an emergency, he has to have lights and siren going to notify those ahead of him to get out of his way.This is true for ALL jurisdictions.

Unfortunately cops RARELY arrest other cops. They call it professional courtesy. So if no one is policing the police than who is gonna ticket him.
Police are allowed to break the Law to enforce the law but this sounds like he was just driving fast for his own reasons and not to "Protect and Serve" the public. If he had been he would have had the lights on. He was actually endangering the public with his driving. But like I said, cops get away with this because even if another cop saw him he probably wouldn't pull him over and if he did he would have just given him a warning because of their professional courtesy.
Also its almost impossible to file a complaint against a Police officer. Beleive me I have tried. You have to go to the Police to file the complaint and they will not give you the form. They badger and threaten you and kick you out of the station. I had a very Legitmate complaint against a police officer harrasing me. He had given me 8 tickets in a 6 month period and would hide on the side of my neighbors house in his motorcylce just to pull me over after work. He would give me fabricated tickets and refuse to show me the radar gun. I won most of my court battles but it took a lot of time and missed work and cost me hundreds of dollars. I tried to file a complaint and was escorted out of the cop station. They refused to let me even file a complaint. Most of the time I hear if they do let you fill out the form they throw it away in the trash after you leave. You have to be careful too because the cop can make life hell for you for filing a complaint.

NO it isint legal. But they never get caught. Just like down here in Georgia, the cops are shooting people left and right and they dont get it trouble. They get off because they are cops.
