Motorcycle organizations have pushed for the "right" of individuals to make this choice. Much the same as MADD has pushed for better "DUI" laws. Some laws are the same in all states because the federal government will withhold highway funds if the states do not make certain laws. An example is the seat belt law, the only state that does not have a mandatory seat belt law is Mass. and they do not get federal dollars because of that, but then the state motto is "live free or die" (good motto). Except for commercial drivers, laws are dictated by the state, commercial drivers cross state lines regularly and are subject to federal laws, however non-commercial drivers are still required to know laws of the state they are driving in.

Some believe it's freedom of choice. In states which have optional helmet laws, traffic collisions have went down, but crashes involving fatalities have risen. Speaking of only those crashes involving motorcycles of course. Wearing a seat belt increases your chances of survival by four times, wearing a helmet improves your odds by three times. Why not take advantage of all opportunities?

In Indiana where it is legal the citizens there are very much into individual rights and view helmet laws as "another thing the govt. is trying to tell us to do".

Not sure about other states.

Some states actually allow their citizens to think for themselves.

Others, worried about getting stuck with the medical bills of someone who had no insurance or cash, pass helmet laws.

Here in Kentucky we do not have to wear a helmet if we have auto and health insurance.Stupid huh

Its up to each state have their own laws on this.....I live in CT and there isn't a law on it....but you do have to wear protective glasses
