A man in my apartment complex caused a fire that killed a 7 month old baby. The man fell asleep while smoking as he was hooked up to an oxygen machine. The mother tried to escape the burning apartment with her baby but as she ran to leave the floor collapsed and she lost the baby in all of the commotion. The baby was found the next day burned beyond recognition. This happened last year the day after Thanksgiving. I recently read in a local paper that the defense is saying that this man had the right to smoke in his apartment eventhought he was hooked to an oxygen machine. They are trying to say that he should not be responsible for what happened even though it caused one death and 22 other families to be homeless. How can someone get away with this??

I know that it is rough because a baby was involved, but accidents do happen. To be all honest with you, who you should really be asking "how did they get away with this?" is the apartment complex. If they're going to allow smoking in their buildings, they should have a better anti-fire system set up.

If they had more preventive measures against fires, the fire would not have spread throughout the complex. Even though the guy "shouldn't" have been smoking because obviously he had a medical condition, he chose to. That was his choice, and there is no law saying he can't. It really is a pitty that a baby died from all of this, but in all actuality, if someone else died that was older, there wouldn't be such a big fuss about it. I can't imagine what it would be like to lose a child because of something like this, but a child's death doesn't make something that is legal, illegal.

Because the law is so messed up that it is pathetic. Take this story right here that happened to my cousin's cousin (No relation to me) she killed her 9 month old baby by smothering it to death and she only got one year in jail and got pregnant while in jail by a guard and she has had 3 kids since the one she killed so tell me now that the law isn't screwed up?

I think that man should be held accountable for starting th fire. That is a very sad story.

This sounded like an accident to me. The man obviously smoked that day and everyday, otherwise he probably wouldn't be hooked up to an oxygen machine. But I'm sure he will feel the guilt for the rest of his life. Maybe enough to quit smoking. Down where I live someone stabbed my friend intentionally, killing him, and got away with it.

He probably deals with guilt every day. Hon, it was a tragic accident, it wasn't like he did it on purpose. He didn't cause the accident his neglect did. I think it was stupidity on his behalf to smoke while on Oxygen, but if he was to had done it on purpose ,then I say find him guilty. People are killing their babies on purpose and getting away with it,this is what we need to be fighting against.
Take for instance,if you put clothes in a dryer and went to bed,and the dryer malfunctioned and caught the house on fire,and someone died in the fire, would it be your fault?,,,Should you be charged with death?Or should the manufacture be charged?

He should be held responsible because he commited a crime. Its just like any crime. When someone drives drunk and kills someone they didn't mean to do it but they still go to jail. When someone shoots a gun in the air and they kill someone they didn't mean to do it they still go to jail. This should be no different. He knew the dangers of smoking while on an oxygen tank. I'm sure that he had been warned, but he still did what he wanted to do and should be held accountable for it.

The same way that people who kill children with their cars by running them over get away with having just a fine. Someone taking a human life needs to be punished whether they meant to take the life or not- then there is no ambiguity as to what should happen for future cases.

What he did was make a terrible terrible mistake that cost a baby its life and so many other families to be homeless.
He IS responsible for what happened but its not premeditated murder.
He will pay...dearly l for the rest of his life and it wont be money that will be the issue.

It was an accident. The man did not do it on purpose nor did he have any intention of killing anyone. The result of his actions caused a death and that is sad but to say HE killed a child is a little far fetched.
I'm surprised how many Americans don't know what actual murder is.

The problem is in the justice system of course, and the way people are sneaking their way out of responsibility for everything lately. Sad state of affairs, I feel for the parents of that baby.
Tragic.
Too bad people just can't kill themselves instead of innocents with their stupidity. Drunk drivers spring to mind as well.

Old people get away with everything...like that guy who lost control of his car and mowed down 10 people and he's not even going to jail because he's too old and sick.
I definitely think this guy should be held responsible...what a terrible story.
