I can't speak to cell phone bans, but I do know that there are laws on the books in many states that specifically exempt on-duty police officers from two-way radio and communicator bans. Maybe there are similar ones in "hands free" areas that exempt them as well.
Keep in mind, that they _usually_ are communicating with other officers (though that surely isn't always the case).

Cops also speed like crazy on duty and off duty. Try to notice how often they wear there seat-belts. I think they have a hard job cause they have to deal with a lot of A holes. So if it keeps me safer at night let them do it. Where i think it goes to far when they drink and drive. If they get pulled over they should get arrested and lose there job. What happens is they just show there badge and go on there way.
