What country ? Because people from certain war-torn countries can apply for political asylum. If she is not from any of these countries that permit political asylum,you will have to apply for the K-1 visa for her. She may however,face penalties because she came illegally. One of my friends married someone who was illegal and he had to go back to Guatemala. He was back in the USA in 9 months because she brought him back.
