It depends on who you are asking - someone who studies plants, or someone who buys groceries at the stores. Technically, a fruit is the a ripened ovary of a flower. Thus, cucumers, pumpkins, and a host of other things we refer to as "vegetables" are actually fruits. However, vegetable is not a botanical term. It is a term used to differentiate between sweet things like apples from more savory things, like broccoli. Vegetables can be any part of a plant - stems, leaves, petals, roots, and yes - even fruits. So, contrary to probably every other answer you'll receive about this question, you are safe to call a tomato a vegetable.

Some like the answer that it is a fruit because it has seeds. Well,there are veggies that have seeds too, like cucumbers, squash, eggplant and on and on. So you can't make a determination based on that.
It is actually a berry.
Botanically speaking, a tomato is the ovary, together with its seeds, of a flowering plant, that is a fruit or, more precisely, a berry.
