Railroad tracks and the beds, berms, bridges, etc. are the property of the railroad. Technically, when you are walking along a railroad track, you are trespassing on railroad property. The railroad doesn't usually do anything about it because they usually don't know you are there. If a railroad supervisor sees you, he/she will often ask you to leave the tracks. They must do that because it is dangerous to walk along railroad tracks and the railroad would be held liable in the event you were injured if they allowed you to walk along there. The exception to this is where the railroad has ceased using a track and has turned it over to the State Parks Dept. for use as a hiking trail. In this case, the state has jurisdiction and they will decide when it is OK for you to walk along it. As for hunting, the railroad normally will not allow it. Often even when the state takes over a strip of old railroad bed, hunting is not allowed because of the danger to hikers who may be using the trail. You need to understand that this is what happens normally. There are exceptions. Contact the railroad, state or whoever owns the rail bed to see what is allowed.

I work on the railroad, the most you can do is cross the tracks, due to have some sort of right away to another property. It is really trespassing if you hang out and walk the tracks because it is the railroads property and that's hunting or no hunting. There are so many deaths, and I have known engineers who hit people. You really don't want to be around the rail systems unless you want some railroad police after your butt. The railroaders are not hesitant to call them. Just be careful and use common sense.

Definatly is the railroads property. There is usually a small sign posted near crossings.
I believe it says no trespassing, but if there isn't a problem with vandels and such, most won't stopp you from just walking along.
Also, if anyone wants to know.. on the crossing signal post is an 1-800 number to cal to report issues, even a stalled vehicle!

i believe it is the rail roads property they own a right of way. but if you carry a rifle along the track's hunting it must be unloaded .
you are not allowed to hunt "in the state of n.y.
within 500 yards of a r.r., river, road,or residence
