No BearShare itself is not illegal. It is just a technology for pear to pear file sharing. What is illegal is sharing copyrighted material (software, music, videos, etc). Unfortunately most users of BearShare use it to trade/share copyrighted songs/videos -- that's what's illegal, and that's what brings a dark cloud on top of BearShare.

downloading music is illegal but who cares. I do it all the time.
