I am a single mother of one. (from my previous marriage) I recently kicked my boyfriend out for continuosly cheating. He and his 13 year old daughter lived with me for over a year. When he left he left his daughter with me because he is a shitty father. (He puts his hoes before his kids) She does not want to live with her mom and her dad does have custody. Her mother said it was okay for her to stay with me. Can I file for assistance if needed because her dad is not dependable and it will be hard for me....but I do not want to turn her away.??????

First, I would call Child Protective Services and start taking fostering / adoption classes to legally have her placed in your home and then go from there. If "dad" doesn't come around for 6 months and you can prove this...it's called abandonment, and would legally be free for other options and his rights would be terminated. At her age, she has the right to express her feelings toward a judge on where she wants to live / doesn't want to live and why! About state assistance...I don't think so, you need to have guardianship of the person to recieve assistance.

If he will sign a consent of guardianship and the mother does also then you could get some assistance. All this says is that for now you will take care of the child rather than the Mother or Father.

If the dad allows it better the chance. if you get a lawyer and show how bad a father he is, the maybe a chance you can get custody. It may depend on where you live.

If you become the child's legal guardian you should then file. It never hurts to try.
