Nope. The bio dad has to terminate is parental rights. Even though you have custody does he still get visitation? If he does, he has to waive his parental rights. Even though you have full custody he still has rights.

No, the bio-logical father must sign stating that he gives over his parential rights otherwise it can not be done. You may want to check into if there is anyway around it. I had a friend that got around it because she proved to the court that he was a dead beat dad and hadnt had anything to do with the child in its life but then again the child was 16 and that might have had something to do with it too.

It probably depends on the state you live in. My step-dad adopted me but my biological father had to sign over his parental rights before this could take place. I'm sure that someone in the legal office at your city could answer this question for you. I would imagine that every state would require the termination of parental rights of the biological father.

Of course if he has a bond with the children and the bio father does not.
He would have to go to the social sercutity office to ask for instructions on changin their last name to his.
He can write a judge and get answers fast.
