Depending on the state you are in, even if this was consensual the DA should be able to get a forcible touching or rape 3rd charge out of this. At the least this is Endangering the Welfare of a Child. But, a lot depends on the details. Was it forced or did the 14 year old consider it consensual? Are there witnesses? How long did the "make out session" occur? And what does the law say in your state?
If the 34 year old has some kind of caregiver status with the child, parent, family member, babysitter, mom's boyfriend, then he can also be charged by Child Protective Services through Family Court.

i think he should be punished some how.. statutatory rape? or making a minor do stuff.. they shouldn't..

Depending where your from? I am not sure........but let me tell you this....if it were my daughter....lets just say there is no way on God's green creation that a PAEDOPHILE would be touching my child!!!! this 34 year old needs to get a grip on reality......what is the problem with guys like this? what ? you can't deal with a big woman? you have obvious control issues....and need some serious intervention!!!

I would consider that MOLESTATION. Regardless of the definition it is illegal, immoral and dangerous.
I certainly hope you are not the 14-year-old girl making out with a 34-year-old man. If you are, please talk to your parents or an adult you trust and stop seeing this man. You're going to get hurt.

You bet it is!! That guy can be prosecuted to the fullest extent of the law for a number of violations, depending on your state - even if the sex was consensual.

If "makes out" means his penis entered your vagina, then yea, it is statutory rape. Statutory means as defined by statute. Your consent or lack thereof is irrelevent.

No, it's considered child molestation and maybe attempted rape. It's definately a crime.
