Anyone can do it, but if any of your clients get audited you cannot represent them unless you are an attorney, CPA or Enrolled Agent.

Anyone who prepares tax returns for a fee is bound by Circular 230.

Unfortunately, just about anyone can hang a shingle and be a tax preparer. Most states and the federal government do not have any licensing requirements. That is going to change in the near future.

You can do it if you know you have a sufficient knowledge on tax issues. However, IRS requires that tax preparers provide due care in tax preparation. This means you need to prepare the return if you have a sufficient knowledge. This issue will be kicked in when IRS has questions on the tax return you have prepared. Good luck.
