No. They don't check. Generally, marriage licenses are issued by the county. They don't check with other counties before issuing.
If you're really ticked off at him, say nothing. After the wedding, call the cops and file a complaint. He'll be arrested and charged with bigamy. It often carries jail time although in his case it would probably be probation.

The State tends to prevent bigamy by setting up the laws so that the person applying for a marriage license is responsible for swearing that they are eligible. If the applicant lies, they are in violation of the law. Checking everyone's application would be challenging, seeing as how the existing marriage could be registered anywhere in the world.
Your soon-to-be-ex-husband is breaking the law. His wedding will not be legal and he could be fined or jailed for fraud.
For fun, you could show up at his wedding and wait for the "speak now or forever hold your peace" line, then stand up and tell everyone that he's still married to you. Alternately, you could wait until the new marriage license is signed then tip off the police...
Of course, the kind thing to do is to tell him now, but he surely knew that he was lying when he signed the application, so, in my opinion, he deserves whatever he gets.

Not only will this wedding not be legal, he can be convicted of fraud. And also bigamy. When he got his license, he was to present his divorce decree papers, which he couldn't do. Then he had to swear to the fact that what he put on the application was true. Better let him know this or his new not-yet-wife will be looking at him through bars.
If HE won't do anything about this contact the Probate Court Judge. (which is where the the license is usually issued from)

No, they really don't. It's happened many times that divorced people THINK they are divorced but papers were not filed on time so that they ended up in bigamy when they did not relaize it.
As long as the judge DOES sign the papers, nothing will really come of it. In fact, the judge will probably sign the papers before the marraige takes place. If he does not, there is nothing you can OR SHOULD do. This is a paperwork problem, which is HIS not yours.

No, they don't always check, especially if the counties or states issuing the licenses are different.
Have a private giggle to yourself. If your license is still legal (meaning you aren't divorced yet), then his new license isn't, even if they have a ceremony.
Have you ever heard stories about people who find out after 25 years of marriage that they aren't really married because of some red-tape hiccup? This is one of them.

When applying for a marriage license, you have to provide proof of divorce if you've been married before. You're right...unless he said he has never been married before then he shouldn't have gotten the license.

Depends on the state...... NJ is very good about checking and it normally takes 20 days to get a marriage cert. Places like TN issue them in a couple of hours and they don't check.
