I wont answer yes or no, coz I really need to study the child case 1st. But what I know the court wont give them the death penalty under Sec 302 coz they r juvenile's. During that period this Juvenile will attend trial if the courts find out the r guilty they will be charged with different punishment. If the trial still go on after age - 21 Then they will be transfer to Prison and at that moment if they were found guilty of coz the sentence wil be death penalty.

If the person has a history and appears mentally sound and has committed the crime with full knowledge of consequences and has murdered in a non-self defence situation, it does not look like there is much else we should be doing.
There are many who think Physical age probably is not a very good benchmark in deciding whether someone could get death penalty. Probably mental age is better. But then, it does not look like there are standards that define mental age that everyone accepts.

On the belief that you are basically saying the teen took a gun to someone and shot them in the head...yes, that would mean they out and out knew this person was fixing to die. If they were beating someone up and the person died, I might feel differently. In Texas, I don't even think they give adults the death penality if the only crime was murder. It has to be capital murder...death, and another felony. I have a 15 year old son so I am trying to look at it in different views. If my son was the murderer, or if someone in my family got murdered by a different teen.

I support the death penalty 100% except in the case of minors. Think back when you were 13- are you the same person.. do you have the same intelligence... were you more susceptible to peer pressure..... was your only goal, to belong... sure 13 year olds know the difference between right and wrong but their mentality about what is most important in life, is still developing... they don't have the same mentality as an adult...

I do not support the death penalty in any form. thsoe children have most likely come from a broken home with abuse of many forms. I work in juvenile and domestic court and I have seen cases of abuse that have made me litterally sick to my stomach. the children act out in many ways and putting them in prison at 13 until they are 18 and then transfering them to adult prison until they are 50 is absolutely rediculous. these are children who have suffered at the hands of their parents and adults in general. we should be providing them with the best counseling and help them become responsible adults. killing them is not the answer and often times people would rather do that(because it's the fastest thing to do) than to invest time and energy and provide much needed help. adults are one thing, children are entirely a different emotional hurdle. you never give up on a child. they simply have lost their direction, let's not forget they are children. look deep into the eyes of your child(if you have any) and then ask yourself if you still support the death penalty for children. no one is born bad. that is rediculous! are you born rascist? of coarse not, that is a learned behavior. you are a product of your enviornment. if a 4 year old hears cursing consistently from birth, he will most likely have a potty mouth. he is not born cursing, he learns it.

no, I understand that there are flaws in our legal system and the effects of jail over death, and the need for human revenge, but I just can't bring myself to support the death penalty. I mean just because someone died, does that give us the right to order another death? does that not make us murderers as well?

I disagree. Percentagewise the US community is a murderous community compared to many other "civilized" communities. Even though those others don't have death penalties. Severe punishment doesn't help to make you civilized.

Every case is different. My cousins son shot his father when he was 14. He had been abused by his father all his life. He was actually in fear for his life when it happened. I didnt agree with his actions but I could understand why he did it. Also I didnt agree with his sentence either. He was held in juvie til he was 18 and put on probation for 10 years after that.

First degree murder is premeditated that means they went there knowing that is what they were gonna do! If anyone; no matter what age decides to kill, the punishment should be death.
