HERE IS THE QUESTION THAT I ASKED ON ANOTHER POST.

Ok when I was 15 years old I got a DWI yes I know I was stupid but I went to court and the judge sentenced me to 1 year probation, comm.service and angermanagment classes and heres the big one he said i could not get my license until I was 21, well I done everything I was told to do. Well I am now 20 and 5 months away from my 21st birthday and I have a 3 year old child and I am also married and it is sooo hard for me not to have my license and I just know there is a way to get them since I have a child and my husband works and theres no way for me to take my child to the doc. or anything like that and i know its 5 months away but i cant wait. So if anyone knows what I can do I really do appreciate it.

No ive never been charged for anything after that, i live in north carolina. I also live in a different county now.

You need a criminal attorney as your situation is the result of a criminal matter.

A criminal defense lawyer or DWI lawyer could help you. You don't need a DWI lawyer specifically, because the process for having your DWI expunged is the same as having a Disorderly Conduct expunged. This involves criminal proceedure more than anything else. Most attorneys in PA charge around $1000, but this process takes a while. You could expect a similar charge down in Carolina.

Your court date would be in about 3 months in the suburbs and more or less in the country or city. Try to determine how much it would cost to either carpool, use public transportation, or to use a taxi. This should help you determine if it may be to your economic advantage to not hire a lawyer, but to wait it out and incur the extra expense of a taxi for the next 5 months.

Additionally, any pleading you would make would have to be within the jurisdiction in which you were originally charged. You could have it removed to a State court, but this would only add time to when you would actually have your hearing on your pleadings.

If you had 3 years to wait, I would say yes, the $1000-$2000 woud be worth it because of the opportunity cost of not having a license to get to a job. With only 5 months to wait, you could spend that money on transportation doing what you have to do, and you wouldn't run the risk of loosing your case, spending the money on the lawyer, and still having to wait 5 months instead of 3.

If the court backlogs are anything like here in Canada you may as well wait out your sentence.

I can't imagine being a mother having an effect on your eligibility for a drivers license as you could take the drivers test and fail anyways .. just like everyone else. The tester will not consider how many children a person has.

I think you're wasting your time, but if you call any Lawyers office they'll probably tell you the same ... you can apply for a license when you're 21.

You need a lawyer who specializes in DWIs and motor vehicle cases. I am sure there are plenty around you. If you have time, you can call the court clerk and ask when those cases are heard, then you can go watch and see if you like any of them. Otherwise you can look one up in the phone book.

Yes you can get a restricted license to drive to and from work only.If you explain this to the judge he can let you get a restricted license that's good for one year. Good luck and stay off that booze!!!!
