I have not recieved my deposit back from my landlord, it has been over 30 days (I believe california law is 21 days).

I made several attempts to get in touch with the landlord, I was succesful once, and she said I would get it within the week, it has now been another couple weeks, and none of my calls or messages have been answered or returned.

I have all the reciepts for the rent and deposit, and since she didnt send me a itemized statement for why she kept the deposit I guess if I go to small claims court that is no defense for her. The apartment was actually in better condition when I left, then when I moved in.

So my question is do I go to my local civil court and file a lawsuit? I have never been through this before any answers/advice would be appreciated.

BTW I live in Central, Ca

Landlords are notorious for keeping deposits for no good reason. I hope you took pictures.. If you go to small claims court they will usually not show up and you win by default... they are banking that you do not have time to sue...If you win then attach something of value that they have to get them to pay.

A phone call to your local cout house wouold answer your question best. I beleive that claims under 5000 dollars can be handled there.
