Not only is that discrimination, aka, illegal, but employers shouldn't even know someone has HIV unless the person voluntarily, for no reason what-so-ever, just decides to tell the employer.

I'm not an employment law attorney (although I am an attorney), but I would say that someone with HIV would qualify as someone with a disability, thus implicating the American's With Disabilities act. As such, as long as the HIV doesn't cause a danger to someone when the person does his job, it is illegal for employers to fail to hire people with HIV. But I would suspect that one could limit those with HIV from working in the health care and food service industries.

Good grief, it's illegal for them to not hire someone because they have HIV, or a sickness or disease, I believe the only way they could get away with something like that was if it was deadly and could be passed around by easy and simple ways, and if that was the case that someone would be in a hospital not trying to get a job. It's called discrimination and they could be sued for all they are worth for it and they would well deserve it. It's like not hiring a woman cause shes a woman, or a man because he has a cold or they are a different skin color or hair color. It is so illegal to discriminate when hiring employees.

RIght, to piggy-back on Panda's answer, it is illegal for an employer to ask such a question to an employee or a potential employee. If this happened to you, and you believe you were terminated for this reason, you may want to speak to a labor and employment law attorney.

Yeah ok, but who's to say who asked what to whom at an interview. Law is directly proportional to a person's ability to enforce it. Employers do discriminate, and so would you if you were them. deal with it.

probably not unless HIV is going to affect other employess like, you wouldn't hire a porn actor with HIV.

No it isnt legal not to hire them for that it is discrimination.
