well married for 8 y have 2 kids one 5 n one 2y old dont get along with her for 2 y now i wanna know in such a condition can i go in for a divorce she also agree that we both donot click. but have my doubts once her family gets involved she can create any problem

Yes I agree with your doubts. Best course is to engage a good divorce advocate move the court without involving your or her relatives. The conditions for divorce are different in different laws. The provisions for divorce under Hindu Marriage Act,1955 apply in a Hindu marriage (both parties Hindu) & marriage was solominised according to hindu ceremonies. The Indian Divorce Act,1869 Applys to christain marriage, whereas provision of Special Marriage Act applys to marriage performed or registered under the Special Marriage Act,1954. Divorce by mutual consent can be obtained U/s28 under Special Marriage Act,1954. Now untill and unless you tell under which law you married it wont be possible to guide you more . Have you tried marriage counseling first? You must realize that children will also have to go through the big emotional turmoil and it can be heart breaking for them. But if you both still find that the situation is not remedy-able, contact a proper attorney. You both should go and talk to him first before contacting or telling the families on either side. Listen carefully to all he has to say and then only take any steps. Try to make sure that she is not left stranded without any means to fend for herself or the children, if she is going to take their custody. Decide on custody of children and dividing property amongst yourself along with the money you may have to pay her at once or on monthly basis for the easiest way to get the divorce. There are some of the biggest complications that come in 'divorce' cases. Only take a decision after you reach a mutual agreement condition on how to carry on with your lives separately and you have talked to the attorney. Make sure it is something that is not remediable before you take the decision.

I suggest try counceling first.U have 2 kids & probably you want to make their world a better place.If you still have problems then go for mutual divorce.

Yes, u can apply for mutual divorce.Be deady to pay maintenance to ur wife (if she is not making much money) & for ur kids(100% court will grant even if ur wife is working).

ur wife cant file 498A , criminal case against u since ur marriage is more than 7 years, but can file case against u with new domestic voilence bill if she want s to misuse the law.So my advice take up ur divorce case in a nice manner if u cant settle ur differences at all.

God, dude, your English is really poor. Hope you don't have to use it much during your work day....

You both can see what is called a mediating divorce attorney (sorry if the word is too large). If you both agree as to who gets what, and how your children will be supported and cared for, it won't cost you much -- $75-$300. It is when you begin to argue, and fight as to who owes whom what, that the attorney fees start to rocket upward.

Because children are involved and there would be custody/child support issues you can't get what is termed a "no fault" divorce anywhere in the U.S. I suggest you both seek lawyers and see what they have to say.

a dissoulution. you can buy the book at a big pharmacy chain, fill out the papers at home, sign them, file them to county court house, appear before judge, make your agreements and walk awy unmarried. no attorneys, only costs about 200 bucks total.
