Unfortunately, it IS. But it SHOULDN'T be.

I can't even begin to figure out how to answer your two questions. And it sounds as if you want someone to do your homework for you.

Alan Dershowitz had some interesting and potentially good ideas in the last part of his book "Supreme Injustice: How the High Court Hijacked Election 2000." He talked about the idea that Republican Presidents have been deliberately appointing people to the Supreme Court on the basis of their far-right ideologies instead of their qualifications. He said that the system of appointing and confirming nominees to the Court should place far more emphasis on the qualifications rather than ideologies. He said that "greatness" should be the most important qualification for a nominee. Dershowitz said that the Senate should reject a nominee who doesn't meet the test of "greatness."

Um, okay. Sounds good. But what does "greatness" mean?

I think that's the question you should be asking here. Not what ARE and HAVE BEEN the characteristics. But what those characteristics SHOULD be.

(And btw, I like the initials "JB." Because my favorite Supreme Court Justice was Justice Black.)

The no.1 characteristic of a Supreme Court nominee is supposed to be impartiality. But because the party in power has the right of appointment, I don't believe that this is possible. Each appointee is going to bring his parties agenda to the table. I believe that the Justices should be chosen from State supreme courts that are elected, by very knowledgeable and experienced judges or legal scholars who have had the time to study their past decisions and legal findings.
