My sister will be 17 next month but she is not well behaved. She gets excellent grades but she sneaks out of the house on weekends and we don't know where she's at. She has been caught with a naked guy in her bed. She's not really doing anything illegal that we know of, but my mom is fed up with her attitude and wants her out of the house. Is this legal?

techinically, no. since your sister is still underaged, but it's not like your sister is an angel either! i wouldn't want her in my house if she was my daughter. your mother makes rules for a reason and it is her house so your sister should follow them. just because she gets "perfect" grades doesn't give her the right to sleep with guys under your parents' roof.

Your mom can not kick her out but she is free to leave at 17. Other than asserting her independance as many young adults do at her age I see no real crisis worthy of being kicked out. Young people have been sneaking around and sexually active for years it's nothing new. Seems like she's focused in school etc. Why does she have to sneak out in the first place, all she should need to be able to do is tell your mom where shes going in case someone needs to contact her in an emergency, etc. Majority of states 16 is the age of sexual consent and once 17 no states really get involved. People always wrongly assume it's illegal on this site when it is not. Under 16 is almost always illegal but there are a few states even under 16 is not.

No i don't think that is legal. Seems to me that would fall under child abandonment. She's not 17 yet, and depending on where you live the legal age is either 17 or 18.

I understand that she is not well behaved, but is there a chance that she is seeking attention. If you mother is willing to throw a sixteen year old out of the house then maybe there are some other issues that need to be resolved.

Not completely. Your mom can't just kick her out of the house without leaving her with some way of taking care of herself. If your sister were considered an adult by law, ie. 18 in the States, then yes. Your mom would have to dump her off at a relatives or set her upp for adoption or something. Leaving her on the streets would cause the police to come in and bring her back.

Of course it is legal for your mother to kick your sister out of the house. She is the one paying the bills and secondly that is her house. Her children are just living there with her. It is great your sister is doing good in school and everything. But that is not the biggest concern. Your mother most likely wants her daughter to follows her rules and give her her respect, if she did, then there wouldn't be a problem. So yeah, it is perfectly legal.

Short of your sister filing for a legal status called "Emancipated Minor", she legally cannot be kicked out. However, her behavior isn't exactly Emily Post, either. She has subjected her male friend to Stat Rape charges, not to mention the fact of being a juvenile delinquent. Also, she has been less than a role model to any younger siblings. Mom's best course is to call in the authorities, and have her sent to "boot camp" or something simular, in order to shock her into being more behaved.

No, if your mother does not have the compassion to take care of her own child, kicking her out is not an option. Sending her to live with relatives, or boarding school or military school is, but not making her live on the street. SHe needs to keep your sister or find a way for her to stay in school graduate,go to college and then she will not be your mothers problem.

I suppose kicking her out is better than killing her. Jeez, I am so glad I had boys. But anyway, your mother should contact Social Services and see if she needs to request a CINA petition (Child in Need of Assistance). Most likely, because of your sister's age they can simply do an emancipation proceeding (declares her an adult and able to live on her own).
But I hope it doesn't come to any of this. Maybe your mother and sister can see a couselor. I would hate to see a family break apart like this.

You can learn from your sister. Don't be like her. I don't agree with what your parents are doing but I don't think it is illegal. I don't know about that. But your sister out in this world as 17 would be hard. Harder than behaving and respecting your parents.

Until she's an adult (18) she has to be living under adult supervision. Relatives, adoption, or foster care are good ideas, but you might try to find a program that talks about the 'darkside' of the things she's been doing. If you find some, you should probably go with her and talk to her about it after.
