decided to take it. i paid last month rent but knew i would be out by the first of the next month. so i canceled the curent rent check because the landlord had not cashed it yet. i have the reciept but now he is saying he has no record of it because in the 5 years i lived there the property was sold 3 times. he is now saying he is going to press charges against me including check fraud and theft of his property for the month i lived there and did not pay him. any info on what he can really do? i live in mass. if it makes a difference. thanks

You will certainly have to pay him for the month that you lived there (this month) also I suspect that you are supposed to give him a month notice so he is completely right and you are completely wrong.

Depends on when the lease expires. If you are in the middle of a lease you will be responsbile for rent until rerented plus a possible a reletting fee. If you are on a month to month lease. Give your notice asap so the rent doesn't accrue. Plus you are going to be hit with NSF fee and late fee. If there is security deposit the landlord should subtract the normal wear and tear of the apartment plus the above fees and you most likely owe him.

If you lived there and did not pay him then you are guilty. Save the court and lawyer costs and just pay him for a month of rent
