In a custody battle, you have a father, who does not own a car but other thain that can prove he is a devoted and caring parent. Verses a mother who admitedly is anorexic, bulimic, has a habit of cutting herself, (in fact has carved the "F" word into her own leg.) She is currently living with her new boyfriend even though she is still married. Also through the advice of her attorny has not let the father see his child for over four months.
The father has two reliable witnesses that can vouge the fact that he is the better parent for the child and that the mother is more interested in her personal life thain that of the childs welbieng.
The father has no lawyer, the mother has highered an attorny, both parties criminal histories are quite minor and negligable.
There is no spousal abuse or child abuse from the father.
who wins?

The father can't help the kid with spelling for school, thain is than, admitedly is admittedly, attorny is attorney, vouge is vouch welbieng is well being, and highered is hired, and negligable is negligible.
Plus you don't say how old the child is or how either parent intends to handle raising the child, daycare, ect.

This is a hard one. From the facts, the father should get custody and the mother should only have limited, supervised, visits. BUT, the way the legal system works, the mother has an attorney and that means a lot. People who defend themselves in court, unless very knowledgable in law and its application, seldomly win. If the children are old enough, they are allowed to voice who they would rather live with. If they're not old enough to make that decision, then its up to the court and then its most likely the one with more money and a better attorney. The fact that he has two reliable witnesses is a step in his favor, backing is better than no backing. He needs to hire someone to defend him and get proof of the wife's activities. AS A POINT IN COURT- he can use the fact that the wife is living with her boyfriend while still married as a point against her. Its providing a child with a living environment unsuitable for their moral upbringing- something a court will look closely at. Tell the father to find what he can against her- the more he proves that she is an unfit mother, the better. Good luck.

Based on what you have said right here, I would pick the father for custody. But this is just one side of the story. I know you have told in part the other side but not all. As everyone knows there are always two sides to every story. But like I said JUST based on what is said here, yes I would pick the father.

If I were the judge, the father would get FULL custody and the mother would go to a mental hospital for about 3 years !!

First things first, Lawyer up... Then take it to the courts. If what you say is true you should have no problem getting the kids. the courts are there for the well being of the kids, Not psycho path moms.. Good luck

I would judge for the father. If the child stays with the mother she could pick up on her traits.

Well if he doesn't have a lawyer the judge will not hear all this so sorry to say but hes screwed..Go to legal Aid get a lawyer!!! then you'll have a chance !!!
