My ex wife is threatning that our said child now 6 is not mine. We were married at the time she was born. Now that we are divorced she does not let me see my said child. I have went to full links to make visitations possible. So now that I have made arrangements to go and get my child for the holidays and not taking no for a answer she is not mine and I have no rights. I know in Illinois that your automaticly considered or assumed to be the father if married to the mother when child is born. I was gone during my said childs birth due to basic tranning. Illinois also has a aknowledgement of paternity you have to sign for your name to go on the birth certificate. My ex put my name on this without a power of attorney.

My question is what are my rights and if a paternity test shows that I am not the father what steps can I take.

If you are not the father, you still have rights. i would suggest you seek a lawyer soon and ask for help. Good Luck...:)

he desires to document court papers suing for partial custody, in view that paternity has not been familiar the court might want to order a try that she has no determination yet to regulate to, as ignoring a court order can be a criminal offense, he might want to ought to pay for the try
